Welcome to 开口派! By accessing or using our services, you agree to be bound by these terms. If you do not agree, please do not use our(Shanghai Fortune Technology Co., Ltd.) services.

2. Service Description

开口派 is an English learning application that provides:

• Personalized English learning courses
• Intelligent learning progress tracking
• Interactive exercises and assessments
• Learning community features

3. User Account

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account password.
• You are responsible for all activities that occur under your account.
• If you discover unauthorized use of your account, please notify us immediately.

4. User Conduct

While using our services, you must not:

• Post illegal, harmful, threatening, abusive, or defamatory content.
• Infringe on the intellectual property or privacy rights of others.
• Spread viruses or malicious code.
• Engage in any activity that may disrupt or damage the service.
• Attempt unauthorized access to our systems.

5. Intellectual Property

• All content and materials in the application are protected by copyright, trademark, and other intellectual property laws.
• You may use our content for personal learning purposes.
• Without permission, you may not reproduce, distribute, or use our content commercially.
• When sharing your own work or derivative works on 开口派, you must not infringe on any third-party intellectual property rights.
• The copyright of recordings or other materials created using 开口派, including those made with existing 开口派 materials, is jointly owned by you and 开口派. By sharing such content, you grant 开口派 and other 开口派 users the right to reproduce and distribute the aforementioned information.

6. Paid Services

• Some features may require a paid subscription.
• Pricing and payment terms will be clearly displayed at the time of purchase.
• Orders are eligible for a no-reason refund within 7 days of purchase; after 7 days, subscription fees are non-refundable unless otherwise required by law.
• We reserve the right to adjust prices at any time.

7. Service Changes and Termination

• We reserve the right to modify, suspend, or terminate the service at any time.
• For significant changes, we will notify users in advance.
• You may stop using the service and delete your account at any time.
• We reserve the right to terminate the service for users who violate these terms.

8. Disclaimer

• The service is provided "as is" without any express or implied warranties.
• We do not guarantee that the service will be uninterrupted, error-free, or completely secure.
• You use the service at your own risk.
• We are not responsible for any losses arising from the use of the service.

9. Limitation of Liability

• To the maximum extent permitted by applicable law, our total liability shall not exceed the fees you have paid to us in the past 12 months.
• You are responsible for securely managing your 开口派 account and password and must not disclose them to any third party. You are responsible for all actions taken under your account, and all activities under your account and password are deemed to be your own actions. The account and password are for your personal use only and may not be lent, transferred, shared, or assigned to any third party without 开口派's consent. In case of violation, 开口派 reserves the right to cancel or permanently freeze your account and seek compensation for any losses caused to 开口派.
• You warrant that you will not post or distribute any information that infringes on intellectual property or other legal rights while using 开口派. You are solely responsible for the legality of any content involving third-party intellectual property rights or other authorizations. 开口派 reserves the right to review or monitor such content for intellectual property ownership or potential infringement of others' civil rights and will comply with relevant regulations by removing or disabling access to suspected infringing content.
• You must not use the 开口派 platform to send any information containing harassment, threats, abuse, intimidation, or similar content, including but not limited to text, images, or voice messages, nor send any spam or messages involving commercial advertisements, promotional links, or pyramid schemes. 开口派 reserves the right to restrict or ban accounts suspected of sending such content.

10. Age Restriction

• 10.1 Adult-Only Service: 开口派 software and related services are provided exclusively to adults aged 18 years or older. If you are under 18 years of age, you are not permitted to register for or use 开口派 software and related services, regardless of whether you have obtained parental consent or are under parental supervision.
• 10.2 Age Verification: Shanghai Fortune Technology Co., Ltd. reserves the right to request proof of age from users at any time. Upon discovering that a user is under 18 years of age, Shanghai Fortune Technology Co., Ltd. has the right to immediately terminate the user's account and services without any refund or compensation obligation.
• 10.3 Parental and Guardian Responsibilities: Parents and guardians are responsible for monitoring and ensuring that minors do not use 开口派 software and related services. If you discover that a minor is using this service, please contact us immediately to handle the account.
• 10.4 Content Publishing Reminder Regarding Minors: To better protect the privacy rights of minors, Shanghai Fortune Technology Co., Ltd. specially reminds you to be cautious when publishing content containing materials of minors. Once published, it is deemed that you have obtained the consent of the rights holder to display the portrait, voice and other information of minors in 开口派 software and related services, and allow Shanghai Fortune Technology Co., Ltd. to use and process such content related to minors in accordance with this agreement.

11. Applicable Law

These terms are governed by the laws of the People's Republic of China. In case of disputes, they should be resolved through friendly negotiation. If negotiation fails, disputes shall be submitted to a competent people's court.

12. Terms Modification

We may update these terms from time to time. Significant changes will be communicated to you via in-app notifications or email. Continued use of the service indicates your acceptance of the modified terms.

Account Deletion: You can submit an account deletion request by going to Me → Settings → Account & Security → Delete Account. After verifying your identity and account status, we will complete the account deletion process within 7 business days.

Once your account has been deleted, you will no longer be able to log in to the account or use the related services. Unless otherwise required by applicable laws and regulations, we will delete or anonymize your personal information.
